Prenuptial/Post Nuptial Agreements

A Prenuptial agreement/premarital agreement is a contract between prospective spouses to determine issues such as equitable distribution/property division and support, prior to the parties’ marriage. This contract will determine how the parties’ assets and liabilities will be treated in the event of a divorce.

There are certain requirements in order to have a valid prenuptial agreement under Florida law.
A prenuptial agreement can be beneficial, however, it is essential that you have a knowledgeable and experienced attorney prepare the agreement and/or properly advise you as to the agreement as you may be waiving your interest in certain assets and/or to support you would otherwise be entitled to under Florida law.

Additionally, if your intent is to protect certain assets you acquired prior to the marriage and/or assets you will be acquiring during the marriage, an ill-prepared agreement can lead to an unenforceable agreement and/or future litigation.
